Conditional Use Application 

• This application must be filled out in five (5) copies, all copies signed by owner, and filed with the Zoning Officer.
• Ten (10) copies of the plan of real estate affected showing the location and size of the lot, location and dimensions of improvements now erected and proposed, parking spaces, all dimensional requirements of the Zoning Ordinance, the building envelope (if applicable), rights of way and easements, together with any other information required by the Board of Commissioners.
• The plan must be prepared and sealed by a Registered Land Surveyor, or a Professional Engineer.

If more space is required, attach a separate sheet to each copy of the application and make specific reference to the question being answered.

Following the commencement of hearings, and until the final decision on the conditional use application is made, neither any Board member nor the hearing officer shall communicate, directly or indirectly, with any party or his representatives in connection with any issue involved, nor shall any party or his representative communicate with any Board member or the hearing officer, except upon notice and opportunity for all parties and all Board members to participate.

The Board of Commissioners shall not take notice of any communication, reports, memoranda, or other materials presented after commencement of the hearings, except advice from their solicitor, unless the parties are afforded an opportunity to contest the material so noticed and shall not inspect the site or its surroundings after the commencement of hearings with any party or his representative unless all parties and all Board members are given an opportunity to be present.

Communication with any Board member by an applicant or an applicant’s representative in violation of the restrictions of this paragraph shall be the basis for dismissing the conditional use application (Township Code, Sec. 255-191).

Zoning Hearing Board Application

Submission Guidelines

• Refer to Upper Dublin Township Zoning Hearing Board Scheduled Meetings List for submission deadlines.
• Zoning Hearing Board applications must be notarized
• Application fees due at time of submission:
  • Residential Use Application Fee: $500
  • Commercial Use Application Fee: $1,500
• Required Documents to be submitted with the Zoning Hearing Board Application
  
  • Three (3) copies of property Deed showing current ownership – Can be acquired from the Montgomery County Recorder of Deeds website.
  • Copies of leases or agreements affecting the premises
  • Eight (8) copies of the plan of real estate affected, showing the location and dimensions of improvements now erected and proposed; parking spaces; all dimensional requirements of the zoning ordinance; the building envelope; rights of way; and easements. The plan must be prepared and sealed by a Registered Land Surveyor, unless this requirement is waived by the Zoning Officer.
  • Eight (8) copies of the Building & Impervious Coverage Form, if applicable.
  • Provide a digital copy of a completed application (notarized application, deed, plot plan, and building coverage form). A digital copy can be submitted by flash drive or email (Total application file size cannot exceed 10 MB and must be in PDF format).

   

  NOTE: The Zoning Hearing Board application will not be accepted or deemed complete by Upper Dublin Township until all of the above items have been submitted to the Zoning Officer’s satisfaction.

   

  Zoning & Planning consultations are available by appointment only: Monday – Friday, 9am – 4pm.

  Upper Dublin Township strongly recommends an applicant submit a set of copies of the following for the Zoning Board at least five (5) days prior to the date of the hearing:

  • Pictures of the front, back, and sides of the property
  • Petition from neighbors giving their consent
  • Copy of a structural drawing, if requested by Zoning Officer
